1. Who I am
Realize Now is the trade name of Wim De Grave, sole proprietorship, registered with the Dutch Chamber of Commerce (KvK) under number 63466279 and VAT number 259429983B01, with its registered address at Lagunesingel 128, 6642EC Beuningen.
You can contact me through the contact form at https://www.realize-now.nl/con....
In these terms, “I”, “me” and “my” refer to Realize Now, and “you” and “your” refer to the person who books, purchases or participates in a service.
2. Scope
2.1 These terms apply to all offers, bookings, purchases and services provided by Realize Now, including individual sessions, session packages, digital recordings, online trainings and free group sessions.
2.2 A consumer is a natural person acting for purposes outside their trade, business, craft or profession.
2.3 By booking or purchasing a paid service, you agree to these terms. Before completing your booking, you will be given the opportunity to read and accept them.
2.4 My services are intended for adults aged 18 and over.
2.5 Any specific terms stated in an offer or product description form part of the agreement. If a specific term conflicts with these general terms, the specific term takes precedence for the relevant service, unless mandatory law provides otherwise.
3. Nature of the services and disclaimer
3.1 Realize Now provides personal development services, including individual sessions, guided exercises, hypnosis-based methods and educational material. These services are not medical, psychological or psychiatric treatment and are not a substitute for appropriate professional care or emergency intervention.
3.2 The methods I use are tools within a broader personal development process. I do not claim that one method is the only valid approach, nor do I exclude other approaches or forms of professional support.
3.3 Decisions concerning medication, medical treatment, psychotherapy or other professional care remain between you and the relevant qualified professional. I do not assume responsibility for the decisions or treatment provided by other practitioners, and I do not instruct you to start, stop or change medication or prescribed treatment.
3.4 I commit to providing my services with reasonable care, attention and professional effort. I do not guarantee a particular outcome. Individual experiences and results vary.
3.5 You remain responsible for your decisions, actions and use of the tools and methods provided. You are responsible for seeking appropriate professional help when needed. Nothing in these terms excludes any duty or liability that cannot legally be excluded.
3.6 Website content, testimonials and examples describe individual experiences or provide general information. They do not guarantee that you will achieve similar results and do not constitute individual medical or psychological advice.
3.7 If you are experiencing a mental health crisis, are at risk of harming yourself or another person, or need urgent medical assistance, contact an appropriate healthcare professional or your local emergency services. My services are not an emergency service.
4. Booking, prices and payment
4.1 You can book through my online booking page. Payment is processed through Stripe or another payment provider identified at checkout. A booking is confirmed when payment has been received and confirmation has been sent, unless the booking process expressly states otherwise.
4.2 All prices are stated in euros. Prices include VAT where applicable, and the total price payable by a consumer is shown before the purchase is completed.
4.3 A package of three individual sessions is normally scheduled at intervals of approximately two weeks. All sessions must be used within [validity period] from the purchase date. Any expiry of unused sessions is subject to applicable consumer law and your statutory withdrawal rights.
4.4 A receipt or invoice will be sent electronically.
4.5 If a payment fails or remains outstanding, I may suspend further delivery after notifying you and allowing any legally required period to remedy the situation. This does not affect rights you have under mandatory law.
5. Preparation and how sessions run
5.1 Sessions take place online via Cal.com and normally last between 60 and 90 minutes. Where an in-person session is offered, the location and arrangements will be stated in the relevant offer.
5.2 You must complete and return any required intake questionnaire at least 24 hours before your first session. If the information is not received in time, I may contact you to reschedule where reasonably necessary.
5.3 You are responsible for joining from a quiet and private place with a stable internet connection. If you arrive late, the session will normally end at the originally scheduled time.
5.4 Participation is voluntary. You may ask to pause or stop an exercise or session at any time.
5.5 Recording of individual sessions
Realize Now may offer session recording for the following purposes:
a. Reviewing sessions and improving the quality of my work.
b. Maintaining continuity between sessions and reviewing relevant aspects of your process.
c. Producing transcripts, notes and summaries using transcription or AI tools.
d. Creating educational or training material, demonstrations and other content.
Recording is not automatic merely because you book a session or accept these terms. Before recording begins, I will provide information about the recording and its intended purposes and obtain the required permission through a separate consent process.
Permission for recording and internal review does not, by itself, authorize use of your recording for AI processing or for training, demonstrations, publication or promotional content. Where separate permission is required for these purposes, I will request it separately.
You may decline recording without losing access to an otherwise available unrecorded session. You may withdraw your consent at any time. If you withdraw consent, I will stop the relevant processing and will not make further use of the recording for the purpose concerned, subject to any lawful reason for retaining or processing information already created.
Recordings, transcripts and summaries will be handled confidentially, with access restricted to authorized persons and service providers as described in the privacy statement. They will not be sold or published as identifiable content without the separate permission required by law.
5.6 Neither party may record a session without the knowledge of the other party and any permission required by law.
6. Cancelling and rescheduling
6.1 You may reschedule an individual session free of charge by giving at least 24 hours' notice before the scheduled start time, using Cal.com.
6.2 If you cancel or request a change within 24 hours of the scheduled start time, or fail to attend without notice, the session may be treated as used, subject to applicable mandatory law and your statutory withdrawal rights.
6.3 Except where required by law or expressly provided in these terms, a cancellation does not automatically entitle you to a refund. You may reschedule under section 6.1. Nothing in this section limits your statutory right of withdrawal or any other mandatory consumer right.
6.4 If I need to cancel or reschedule a session, I will offer you an alternative date. If we cannot agree on a suitable date, I will refund the amount paid for the cancelled session, without affecting any additional rights you may have under applicable law.
6.5 The cancellation rules in this section concern appointments and do not replace the statutory withdrawal rules in section 7.
7. Right of withdrawal for consumers
7.1 If you are a consumer purchasing online or at a distance, you generally have a statutory withdrawal period of 14 days, starting on the day after the agreement is concluded for a service, subject to applicable law and any relevant statutory exceptions.
7.2 You may exercise your right of withdrawal by using the withdrawal form or online withdrawal facility at https://www.realize-now.nl/wit..., or by sending an unequivocal statement through https://www.realize-now.nl/con.... You do not have to give a reason. I will confirm receipt where required.
7.3 Starting a service during the withdrawal period
If you ask me to start a service before the 14-day withdrawal period has ended, I will obtain your express request before starting. If you subsequently withdraw after the service has started, you may be required to pay a proportionate amount for the service already supplied, where the law permits this.
For a service to be fully exempt from the right of withdrawal because it has been completely performed during the withdrawal period, the applicable statutory conditions must be met, including your prior express consent to the service starting and your acknowledgement that you lose the right of withdrawal once the service has been fully performed.
Acceptance of these terms alone does not replace any separate request or acknowledgement required by law.
7.4 Digital content
For digital content not supplied on a tangible medium, such as downloadable recordings or online material, different withdrawal rules may apply. If you request immediate delivery during the withdrawal period, I will obtain your prior express consent to immediate delivery and your acknowledgement that you lose your right of withdrawal once delivery begins, where the law permits this consequence.
Where required, I will confirm the relevant consent and acknowledgement to you on a durable medium, such as by email.
7.5 If you withdraw validly, I will reimburse the amount due within the statutory period, using the same payment method unless you expressly agree otherwise. Any lawful deduction for services already supplied will be calculated in accordance with applicable law.
7.6 This section applies to consumers. It does not restrict any mandatory rights that may apply to other customers.
7.7 A model withdrawal form is available at https://www.realize-now.nl/wit....
8. Recordings and digital trainings
8.1 Digital products, including audio recordings and online trainings, are delivered or made available electronically after payment, according to the product description.
8.2 Where digital content is made available immediately, I will obtain any separate express consent and acknowledgement required under section 7 before immediate delivery if you are a consumer within the withdrawal period.
8.3 Digital products and training materials are licensed for your personal use only. You may not copy, distribute, resell, publish, publicly share or commercially exploit them without my prior written permission, except where mandatory law provides otherwise.
8.4 Do not listen to hypnosis, relaxation or guided-exercise recordings while driving, operating machinery or performing any activity that requires your full attention or alertness.
8.5 You are responsible for using digital materials in an appropriate environment and for stopping playback if you feel uncomfortable or unwell.
9. Free group sessions
9.1 Participation in free group sessions is voluntary. Sections 3, 5.5, 10, 11 and 13 apply as relevant.
9.2 Participants are expected to respect the privacy of others and not to disclose personal information shared by other participants outside the group without their permission.
9.3 Participants must not record, photograph, screenshot or otherwise capture a group session or its participants without the prior permission of everyone whose image, voice or personal information would be captured, and any other permission required by law.
9.4 I will explain before a group session whether any recording is proposed and for what purpose. If recording is planned, I will obtain the required permissions before recording begins. A participant who does not agree to a proposed recording must be offered a reasonable way to participate without being recorded, where practicable.
9.5 I cannot guarantee that every participant will comply with the confidentiality expectations in this section. Please share only information you are comfortable sharing in a group setting.
10. Confidentiality
10.1 I treat information you share during individual sessions as confidential, subject to applicable law and the exceptions described in this section.
10.2 Confidential information will not be disclosed to other people except where necessary to provide the service, where you have given appropriate permission, where a service provider processes information on my behalf under suitable safeguards, or where disclosure is required or permitted by law.
10.3 Confidentiality cannot be guaranteed in relation to information shared by other participants in a group session. Participants are asked to respect one another's privacy, as set out in section 9.
10.4 Nothing in this section prevents me from complying with a lawful obligation or taking necessary action in circumstances where the law permits or requires disclosure to protect vital interests or address a serious and imminent risk.
11. Personal data and privacy
11.1 I process personal data in accordance with applicable data protection law, including the General Data Protection Regulation (GDPR), and my privacy statement at https://www.realize-now.nl/pri....
11.2 Personal data may include contact and booking details, payment-related information, intake questionnaire responses and information you share during sessions. I use this information only on an appropriate legal basis and for specified purposes, such as administering bookings, providing services, communicating with you and meeting legal obligations.
11.3 If you consent to session recording, the recording may contain personal and potentially sensitive information. Transcripts and AI-generated summaries may contain the same information. The purposes, legal bases, recipients, retention periods and safeguards applicable to these materials are explained in the privacy statement and the relevant consent information.
11.4 Where external platforms or AI service providers process personal data, I will identify the relevant categories of providers and explain the applicable processing arrangements in the privacy statement. I will use appropriate safeguards where required by law.
11.5 You may exercise the rights available to you under applicable data protection law, including rights of access, correction, erasure, restriction, objection and withdrawal of consent where applicable. Details of how to exercise these rights are provided in the privacy statement.
11.6 Personal data will not be retained longer than necessary for the purposes for which it is processed, unless a longer retention period is required or permitted by law.
12. Intellectual property
12.1 All intellectual property rights in materials created or supplied by Realize Now, including texts, recordings, exercises, training materials, methods presented in original materials and other content, remain with their respective rights holders.
12.2 You receive a personal, non-exclusive and non-transferable right to use purchased materials for your own personal use, subject to the relevant product terms.
12.3 You may not reproduce, distribute, resell, publish, teach from or commercially exploit protected materials without prior written permission, except where mandatory law permits such use.
12.4 Nothing in this section restricts rights you may have under mandatory copyright or other applicable law.
13. Liability
13.1 I provide my services with reasonable care and skill. I am liable for loss or damage to the extent required by applicable law.
13.2 Nothing in these terms excludes or limits liability for matters for which liability cannot lawfully be excluded or limited, including liability where such an exclusion is prohibited by mandatory consumer law.
13.3 Subject to sections 13.1 and 13.2, I am not responsible for indirect loss or for decisions you make about your health, medication, treatment, work, finances or relationships, except to the extent that the law provides otherwise.
13.4 Where a limitation of liability is legally permissible, liability may be limited to the amount paid for the service giving rise to the claim, to the extent that such a limitation is enforceable under applicable law.
13.5 You remain responsible for your own decisions and actions, but this does not remove any duty of care or legal responsibility that I owe you.
14. Force majeure
14.1 Neither party will be responsible for a delay caused by circumstances beyond their reasonable control, to the extent permitted by law. Examples may include serious illness, major technical failures, power outages or widespread internet disruptions.
14.2 If such circumstances prevent me from providing a booked session, I will offer a reasonable alternative date or, where the session cannot reasonably be rescheduled, refund the amount paid for the affected session.
14.3 This section does not remove any mandatory rights you may have under applicable law.
15. Complaints
15.1 If you have a complaint about a service, please contact me through https://www.realize-now.nl/con..., explaining the issue and the outcome you are seeking.
15.2 I will acknowledge and respond to your complaint within 14 days. If a substantive response requires more time, I will let you know and indicate when you can expect a further response.
15.3 We will make a reasonable effort to resolve the complaint directly and amicably. This does not prevent you from exercising any statutory rights or bringing a claim before a competent authority or court.
16. Applicable law and disputes
16.1 Dutch law applies to these terms and the agreements they cover, without prejudice to mandatory consumer protection provisions that apply to you.
16.2 If you are a consumer residing in another country, this choice of law does not deprive you of the protection afforded by provisions of the law of your country of habitual residence where those provisions apply mandatorily.
16.3 Disputes will be submitted to the competent court under the applicable procedural and consumer protection rules. Nothing in this section removes a consumer's right to bring proceedings before a court where mandatory law permits it.
17. Changes and validity
17.1 The version of these terms in force at the time of your booking or purchase applies to that agreement, unless a change is required by law or otherwise lawfully agreed.
17.2 I may update these terms for future bookings and purchases. The current version will be published at https://www.realize-now.nl/ter..., with its version date.
17.3 If any provision is found to be invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law. The invalid provision will be interpreted or replaced, where legally possible, in a way that most closely reflects its original lawful purpose.
